These Terms of Service (“Terms”) govern your access to and use of GrandKidCentral.com and any pages, articles, features, content, resources, recommendations, tools, or other materials made available through the website (collectively, the “Site”).

The Site is owned and operated by GrandKid Central, LLC (“GrandKid Central,” “GKC,” “we,” “us,” or “our”).

Please read these Terms carefully. By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Site.

1. About GrandKid Central

GrandKid Central is an informational, editorial, family-resource, product-recommendation, and affiliate-referral website created primarily for grandparents, parents, guardians, caregivers, and other adults interested in information, ideas, activities, products, and resources relating to grandchildren and families.

Among other things, the Site may provide:

Articles and educational content;
Grandparenting information and resources;
Gift ideas and product recommendations;
Activity and recreation ideas;
Family, health, wellness, safety, education, technology, and lifestyle information;
Links to third-party products and services;
Affiliate links;
Advertisements or sponsored content, where applicable; and
Other resources we believe may be useful to our readers.

GrandKid Central is not a retailer of the third-party products featured on the Site. Unless expressly stated otherwise, we do not manufacture, stock, sell, process payment for, fulfill, or ship those products.

When you follow a link from GrandKid Central to a third-party retailer, any resulting transaction is between you and that third party.

2. Eligibility and Use by Minors

The Site is intended primarily for adults. You must be at least 13 years old to use the Site independently. If you are under the age of majority where you live, you should use the Site only with the involvement and permission of a parent or legal guardian.

5. Product Recommendations

GrandKid Central may recommend, review, compare, discuss, or link to products and services we believe may be useful or interesting to our readers.

Product recommendations represent editorial judgments based on information reasonably available to us at the time of publication. A recommendation does not constitute a guarantee, certification, warranty, or representation that a product is appropriate for every person, child, circumstance, or intended use.

GrandKid Central participates in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for websites to earn advertising fees by advertising and linking to Amazon.

GrandKid Central may also participate in the Walmart Affiliate Program and other affiliate programs.

The existence of an affiliate relationship does not constitute a warranty or guarantee concerning the applicable product, retailer, merchant, or service.

7. Third-Party Retailers and Purchases

GrandKid Central is independent from the third-party retailers and merchants to which we link unless expressly stated otherwise.

If you click a product link and make a purchase from Amazon, Walmart, or another third-party retailer: The transaction occurs directly between you and the retailer. GrandKid Central is not the seller of the product and does not control the transaction.

The retailer is responsible for matters such as:

Payment processing;
Order acceptance;
Inventory;
Product fulfillment;
Shipping and delivery;
Sales tax;
Returns;
Refunds;
Exchanges;
Product warranties;
Customer service; and
Other terms applicable to the transaction.

Your transaction is governed by the terms, conditions, privacy policies, return policies, warranties, and other policies of the applicable retailer.

Questions or disputes relating to a third-party purchase should generally be directed to the retailer from which you purchased the product.

8. Prices, Availability, Ratings, and Product Information

Product information displayed or discussed on the Site may originate from manufacturers, retailers, affiliate partners, publicly available sources, or other third parties.

Prices, discounts, promotions, coupon offers, shipping terms, product specifications, customer ratings, reviews, colors, sizes, models, availability, and other product information can change without notice.

GrandKid Central does not guarantee that any price, availability, discount, rating, product description, specification, image, or other third-party product information appearing on the Site remains current or accurate.

The information displayed by the retailer at the time of your transaction controls.

You should verify important product details directly with the manufacturer or retailer before purchasing.

9. Product Recalls and Safety Information

Product safety information may change after an article or recommendation is published.

GrandKid Central does not guarantee that the Site will contain the most recent recall, warning, safety notice, or regulatory information concerning every product discussed.

Before allowing a child to use a product, you should review current manufacturer instructions and warnings and, where appropriate, current product-recall information from relevant government authorities.

If a product has been recalled or is reasonably suspected to be unsafe, discontinue use and follow the instructions provided by the manufacturer, retailer, or appropriate authority.

10. Third-Party Websites and Services

The Site may contain links to third-party websites, applications, retailers, social-media platforms, services, articles, videos, or other resources.

These links are provided for convenience, reference, product discovery, or other informational purposes.

A link does not necessarily mean that GrandKid Central endorses or controls the third-party website or everything appearing on it.

We do not control and are not responsible for the availability, content, security, accuracy, privacy practices, products, services, policies, or business practices of independent third parties.

When you leave GrandKidCentral.com, your use of the destination website or service is governed by that third party's terms and policies.

11. Intellectual Property

Unless otherwise indicated, the Site and its original content, including text, articles, graphics, photographs, images, illustrations, logos, page designs, layouts, compilations, videos, downloadable materials, and other original materials created by or for GrandKid Central (“GKC Content”), are owned by or licensed to GrandKid Central and are protected by applicable copyright, trademark, and other intellectual-property laws.

Third-party trademarks, product names, retailer names, photographs, logos, and other third-party content remain the property of their respective owners.

Nothing on the Site grants you ownership of any GKC Content.

12. Limited License to Use the Site

Subject to these Terms, GrandKid Central grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Site and GKC Content for lawful, personal, and non-commercial purposes.

Unless GrandKid Central gives prior written permission, you may not:

Reproduce substantial portions of the Site;
Republish articles or other GKC Content;
Sell, license, rent, or commercially exploit GKC Content;
Modify or create derivative works from GKC Content for commercial purposes;
Remove copyright, trademark, attribution, or proprietary notices;
Copy the Site or its content to create a competing website, database, product, or service; or
Use GKC Content in a manner that infringes GrandKid Central's intellectual-property rights.

Ordinary personal sharing of links to GrandKid Central articles or pages through email, text messaging, or social media is permitted and encouraged, provided that the content is not misrepresented and attribution or links to GrandKid Central are not removed.

13. Automated Access, Scraping, and Artificial Intelligence

Except as expressly authorized by GrandKid Central or permitted by applicable law, you may not use automated systems—including bots, crawlers, scrapers, spiders, data-mining tools, or similar technologies—to systematically access, copy, extract, collect, reproduce, or compile substantial portions of the Site or GKC Content.

You may not use GKC Content to create or populate a competing commercial database, website, publication, product-recommendation service, or similar service without prior written permission.

You also may not use substantial quantities of GKC Content to train, fine-tune, develop, benchmark, or improve a commercial artificial-intelligence, machine-learning, or generative-AI model without GrandKid Central's prior written permission, except to the extent such restriction is prohibited by applicable law.

Nothing in this section is intended to prohibit ordinary search-engine indexing consistent with generally accepted search-engine practices or any activity that GrandKid Central expressly authorizes.

14. Trademarks

“GrandKid Central,” “GrandKidCentral.com,” “GKC,” associated logos, slogans, designs, and other GrandKid Central brand identifiers are trademarks, service marks, or other proprietary identifiers of GrandKid Central, LLC, as applicable.

You may not use GrandKid Central's names, logos, marks, or branding in a manner that falsely suggests sponsorship, endorsement, affiliation, or approval without prior written permission.

Amazon, Walmart, and other names, trademarks, logos, and brands appearing on the Site belong to their respective owners. References to third-party brands do not imply ownership by GrandKid Central.

15. User Submissions

The Site may occasionally allow users to submit comments, reviews, photographs, stories, responses, contest entries, or other content (“User Content”).

If you submit User Content for public display, you represent and warrant that:

You own the content or have permission to submit it;
The content does not infringe another person's intellectual-property, privacy, publicity, contractual, or other rights;
The content is truthful to the best of your knowledge;
The content does not contain unlawful, defamatory, threatening, obscene, fraudulent, or malicious material; and
Your submission complies with these Terms.

By intentionally submitting User Content for public display, you grant GrandKid Central a non-exclusive, worldwide, royalty-free license to reproduce, display, distribute, adapt, and otherwise use the User Content in connection with the Site, GrandKid Central's social-media channels, and promotion of GrandKid Central.

This license does not apply merely because you submit a private question or message through our Contact Us form or communicate privately with us by email.

We reserve the right, but do not assume an obligation, to review, edit, reject, or remove User Content that violates these Terms or that we otherwise determine is inappropriate for the Site.

16. Feedback and Suggestions

If you voluntarily provide ideas, suggestions, corrections, recommendations, or other feedback concerning GrandKid Central or the Site, you agree that we may consider and use that feedback without an obligation to compensate you, provided that our handling of personal information remains subject to our Privacy Policy.

17. Prohibited Uses

You agree not to use the Site to:

Violate any applicable law or regulation;
Infringe copyrights, trademarks, privacy rights, publicity rights, or other rights of another person;
Transmit malware, viruses, malicious code, or harmful software;
Attempt to gain unauthorized access to the Site, servers, accounts, systems, or networks;
Circumvent security or access-control measures;
Interfere with or disrupt the operation or security of the Site;
Conduct fraudulent, deceptive, abusive, threatening, or harassing activity;
Impersonate another person or entity;
Misrepresent your affiliation with GrandKid Central;
Harvest personal information about other users;
Send spam or unsolicited commercial communications through the Site;
Use automated means in violation of Section 13;
Attempt to reverse engineer Site technology except where applicable law expressly permits it; or
Use the Site for any unlawful or unauthorized commercial purpose.

We may restrict or terminate access to the Site for conduct that violates these Terms or threatens the security, integrity, or lawful operation of the Site.

18. Copyright Complaints and DMCA

GrandKid Central respects intellectual-property rights.

If you believe material appearing on the Site infringes your copyright, please review our DMCA Policy for instructions concerning submission of a copyright-infringement notice.

When you contact GrandKid Central electronically, you consent to receive electronic communications from us that are reasonably related to your request or interaction.

This provision does not, by itself, constitute consent to receive marketing emails or text messages where separate consent is required by law.

Electronic communications may include email responses, Site notices, or other communications reasonably related to your use of the Site.

21. Site Availability and Changes

We may modify, update, suspend, discontinue, or restrict any portion of the Site at any time.

We do not guarantee that the Site or any particular content, feature, link, recommendation, product listing, or resource will always be available.

We may correct errors or update content without prior notice.

22. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL CONTENT, INFORMATION, RECOMMENDATIONS, LINKS, MATERIALS, AND FEATURES MADE AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. GRANDKID CENTRAL MAKES NO WARRANTY OR REPRESENTATION, EXPRESS OR IMPLIED, REGARDING THE SITE OR ITS CONTENT, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, RELIABILITY, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SITE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED. GRANDKID CENTRAL DOES NOT WARRANT OR GUARANTEE ANY THIRD-PARTY PRODUCT, SERVICE, RETAILER, MANUFACTURER, MERCHANT, WEBSITE, OR AFFILIATE PARTNER.

Some jurisdictions do not permit the exclusion of certain implied warranties, so portions of this section may not apply to you.

23. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GRANDKID CENTRAL, LLC, AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY THIRD-PARTY PRODUCT, SERVICE, CONTENT, LINK, OR WEBSITE.

This includes, to the extent permitted by law, damages arising from:

Reliance on Site content;
Product recommendations;
Purchases from third-party retailers;
Product defects or misuse;
Third-party acts or omissions;
Interrupted or unavailable Site access;
Data loss;
Malware or security incidents originating from third-party systems; or
Errors or omissions in Site content.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GRANDKID CENTRAL'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO GRANDKID CENTRAL FOR USE OF THE SITE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.

Because GrandKid Central generally provides Site access without charging visitors a fee, in many cases the applicable maximum will be $100.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

24. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless GrandKid Central, LLC, and its members, managers, officers, employees, contractors, agents, affiliates, successors, and assigns from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys' fees arising from or relating to:

Your unlawful or unauthorized use of the Site;
Your material violation of these Terms;
User Content you submit;
Your infringement or violation of another person's rights; or
Fraudulent, malicious, or intentionally wrongful conduct by you in connection with the Site.

GrandKid Central reserves the right to assume control of the defense of a matter subject to indemnification, in which case you agree to reasonably cooperate with that defense.

25. Governing Law

These Terms and any dispute arising out of or relating to the Site or these Terms will be governed by the laws of the State of Utah, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.

Nothing in these Terms is intended to deprive a consumer of non-waivable rights or protections provided by applicable law.

26. Jurisdiction and Venue

Except where applicable law provides otherwise, any legal action arising out of or relating to these Terms or the Site shall be brought in an appropriate state or federal court located in Utah County, Utah, and you consent to the personal jurisdiction and venue of those courts.

Nothing in this section prevents GrandKid Central from seeking injunctive or other appropriate relief in another jurisdiction when reasonably necessary to protect intellectual-property rights, confidential information, Site security, or other legal rights.

27. No Waiver

GrandKid Central's failure to enforce any provision of these Terms does not constitute a waiver of that provision or of our right to enforce it later.

A waiver is effective only if expressly made in writing by an authorized representative of GrandKid Central.

28. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or, where appropriate, severed from these Terms.

The remaining provisions will continue in full force and effect.

29. Assignment

You may not assign or transfer your rights or obligations under these Terms without GrandKid Central's prior written consent.

GrandKid Central may assign or transfer its rights and obligations under these Terms in connection with a merger, acquisition, reorganization, sale of assets, transfer of business operations, or similar transaction, subject to applicable law.

30. Entire Agreement

These Terms, together with the Privacy Policy, Affiliate Disclosure, DMCA Policy, and any other policies or notices expressly incorporated by reference, constitute the entire agreement between you and GrandKid Central concerning your use of the Site.

If a specific promotion, feature, contest, or service is governed by additional terms, those additional terms will also apply to that activity.

31. Changes to These Terms

We may update these Terms periodically to reflect changes in the Site, our business practices, technology, legal requirements, affiliate relationships, or other circumstances.

When we update these Terms, we will revise the “Last Updated” date at the top of this page. Changes become effective when posted unless a later effective date is stated.

Where applicable law requires additional notice or consent for a particular change, we will provide that notice or obtain that consent as required.

Your continued use of the Site after revised Terms become effective constitutes acceptance of those revised Terms to the extent permitted by applicable law.
